These terms cover your use of the Mipkin app. Mipkin is operated by Eros Media LLC (“we”, “us” and “our”), 1000 Brickell Ave., Suite 715, Miami, Florida 33131, United States. They are meant to be readable; the short version is that the app is yours to use, we will not pretend it is medical care, and you can leave whenever you like taking your data with you.
What Mipkin is
A companion app for everyday wellbeing: a creature to look after, gentle prompts, small things to do, and somewhere to write. It is a comfort object with structure, not a treatment.
It is not medical or mental health care. Mipkin does not diagnose, treat, cure or prevent any condition. Nothing in it is medical, clinical, psychological or therapeutic advice, and nobody involved in it is acting as your therapist, counsellor or clinician. It is not a crisis service and cannot respond to an emergency.
If you are in danger or in crisis, contact your local emergency service. In the US you can call or text 988 to reach the Suicide & Crisis Lifeline. The app also links to a maintained directory of local helplines.
Do not use this app in place of care from a qualified professional, and do not delay seeking that care because of anything the app says.
Reflections, and what a language model is
If you switch on reflections, what you write on your own journal pages is sent to a language model, which writes a short response. That response is generated text. It may be wrong, it may miss the point, and it is not advice. It is instructed never to diagnose, never to name a condition, and never to present itself as a professional — but no instruction to a model is a guarantee, and you should read what comes back as what it is.
The feature is off until you turn it on, and turning it off stops it entirely.
Visiting
Visiting is an optional, code-based way to let another person see a generic Mipkin visitor with optional growth and wearable choices. It never shares which companion you chose. It is not a chat, feed, leaderboard or relationship score. Do not share a hearth code publicly. You can revoke a code in Settings; if your phone is offline, it will say that revocation has not yet completed.
Your content
What you write is yours. We claim no ownership of it and no licence to use it. It is stored on your device. A reflection you request is the only time your journal text goes anywhere. Visiting and optional account recovery use the limited data described in the privacy policy; neither receives your journal text.
Age
You must be at least 13 to use Mipkin. If you are under the age of majority where you live, you should have a parent or guardian's permission, and they should read these terms too.
Subscriptions and purchases
The app is free to use. Mipkin Plus is an optional subscription, and there are optional one-off purchases. All of them are billed by Apple or Google, not by us.
- A subscription renews automatically at the end of each period until you cancel it.
- You cancel in your Apple or Google account settings, not in the app. Cancelling stops the next renewal; it does not refund the current period.
- If you take a free trial and do not cancel before it ends, it becomes a paid subscription at the price shown when you started it.
- A one-off purchase is not a subscription and does not renew.
- Refunds are handled by whichever store you bought from, under that store's policy. We cannot issue refunds for store purchases ourselves.
- Prices may change for new purchases. An existing subscription is not repriced without notice and an opportunity to cancel.
If Plus ends, nothing you earned is taken away: your companion, your warmth, your decor, your keepsakes and everything you wrote stay exactly where they are. Paid extras simply stop applying.
Fair use
Please do not try to break the service, work around the rate limits, use it to send content that is not your own journal writing, or resell access to it. The reflections endpoint is rate limited, and we may decline requests that look automated.
Availability
The app works offline and will keep working if our service does not. Reflections need a connection and our service to be up; when either is missing, the app tells you plainly and saves your writing regardless. We do not promise uninterrupted availability of the reflections service.
Warranties and liability
The app is provided as is, without warranties of any kind to the fullest extent the law allows. To the fullest extent permitted by law, our total liability arising out of your use of the app is limited to the amount you actually paid us for it in the twelve months before the claim. Nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud.
Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you. If you are a consumer, you keep every right your local consumer law gives you, and nothing here takes those away.
Ending it
You can stop using the app at any time by deleting it, which removes everything it stored. We may end or suspend access if the app is being used to attack the service or break these terms.
Changes to these terms
If these terms change materially, the app will say so before the change applies to you. The date at the top is the record of when they last changed.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. If mandatory law where you live gives you additional consumer rights, nothing in these terms takes those rights away.
